After nearly a decade in cannabis extraction, processing and testing, and experience operating in 13 regulated markets across the U.S, one thing remains unchanged: no two states agree on how to regulate the same plant.
The same cannabis plant, grown under identical conditions, can face different testing standards depending on where it’s sold. What passes in Michigan might fail in Pennsylvania. What’s labeled compliant in Illinois may require reformulation or packaging changes to meet Florida regulations. At ACT LAB, we operate in six states and see firsthand how regulatory nuances can make or break a product’s path to market.
Here’s why multi-state cannabis testing demands more than just compliance—it requires a lab partner who understands each market’s science, standards, and shifting regulations.
The Challenge: One Plant, Fifty Playbooks
While federal cannabis legalization remains uncertain, each state continues to define its own regulatory framework. That means testing requirements for THC and CBD potency, terpenes, residual solvents, heavy metals, pesticides, and minor or synthetic cannabinoids vary widely—and change frequently, including:
- Total THC definitions vary by state. Some states include THCa in their calculations using a conversion factor; others don’t.
- Terpene reporting may be optional in one market and mandatory in another, with differing thresholds and allowed variances.
- Minor cannabinoids like CBG or CBC may be increasingly relevant to product differentiation, but not all states require or even allow them to be labeled.
- Action limits for contaminants such as heavy metals or mold are far from uniform, meaning a batch passing in one state can fail elsewhere.
For brands attempting to scale across multiple states, these variances in regulations aren’t just a technicality, they create roadblocks which can impact a business’s bottom line by influencing how products are formulated, labeled, marketed, and perceived by regulators and consumers alike.
The Risks: Inconsistency Has Consequences
When brands rely on labs that lack regulatory depth or consistency in their methods, the results can be costly. Failed batches lead to wasted inventory. Labeling inconsistencies risk compliance violations. Even worse, fluctuating potency or terpene profiles erode consumer trust.
We’ve seen this play out time and again with customers who turn to ACT LAB after being flagged for noncompliance.
A brand came to ACT LAB after their edible product, tested and cleared by another lab, generated numerous consumer complaints about overwhelming intoxication. The original lab had significantly under-reported total THC. As a result, the state requested retesting by a different lab, which revealed the actual potency far exceeded the label claim. The client had to initiate a costly product recall. After we delivered consistent, accurate potency data and helped support the brand through the recall process, the client shifted 100% of their testing to ACT LAB.
In another example, a cultivator was using a lab that flagged multiple flower batches for microbial contamination. Based on those results, the state required product destruction, tens of thousands of dollars in lost revenue. When they came to ACT LAB for secondary testing and consultation, we discovered the original lab was using a test method with a high rate of false positives. Our validated methodology provided accurate quantification of microbial load, and the client was able to avoid future unnecessary destruction. Over time, ACT LAB became their primary lab due to our reliability and transparency in microbial testing.
In a separate case, a processor was sourcing minor cannabinoids like CBN and CBC from out-of-state suppliers. When they tested them locally before formulation, results from the supplier’s lab didn’t align with in-market testing. This led to final products that consistently missed label targets and required relabeling or reprocessing. ACT LAB helped this client vet suppliers and validate inputs using our high purity testing protocols. The client now sends all incoming raw materials to ACT LAB before production and has seen a major reduction in failed batches and customer complaints about inconsistency.

The Science Behind the Standards
Cannabis is complex. Testing it accurately and reproducibly across regulatory environments requires deep scientific knowledge and careful calibration. Differences in instrumentation, sample preparation, reference standards, and data interpretation can all impact the final result.
That’s why ACT LAB’s approach is rooted in applying scientific rigor to every step of the testing process; while ensuring we meet or exceed the specific regulations of each market in which we operate. Our multi-state network is unified by quality assurance best practices and localized in regulatory expertise.
We know how to navigate the changing definitions of “total THC.” We stay on top of each state’s evolving terpene reporting rules. We know when a batch will pass—and when it won’t. And more importantly, we collaborate with our partners to prevent surprises before they happen.
The Importance of Accreditation

A clear indicator of a reliable lab partner is third-party accreditation—and ACT LAB is proud to meet that standard.
ACT LAB is accredited by the American Association for Laboratory Accreditation (A2LA) in accordance with the internationally recognized ISO/IEC 17025:2017 standard, ensuring our methods are fully validated and independently reviewed.
This accreditation demonstrates that ACT LAB not only has the technical competence needed to perform cannabis testing across markets, but that we operate a rigorous quality management system to ensure accuracy, repeatability, and reliability.
For our customers, this means added confidence that every result, whether for potency, terpenes, or contaminants, is backed by a lab that meets the highest global benchmarks for quality and performance.
ACT LAB: Your Multi-State Testing Partner
With operations in six states and growing, ACT LAB is uniquely positioned to support brands looking to scale across state lines. We’re more than just a testing provider, we’re a regulatory-aware, science-forward partner who can help you go to market with confidence.
Here’s how we support our partners:
- Localized Regulatory Intelligence: We monitor and interpret each state’s regulations to ensure our customers can make business-forward decisions, while ensuring consumer safety.
- Consistent Methods Across Labs: Our validated, synchronized methods ensure comparability of data across state lines, reducing surprises and increasing trust. Our methods are also harmonized for both cannabis and hemp testing, so cannabis brands developing products like hemp-infused beverages or gummies, can expect testing method consistency across industries.
- Formulation Support: We help you understand how evolving definitions (like total THC) or new reporting requirements impact your product development.
- Risk Mitigation: We proactively flag compliance risks and guide you through reformulation, labeling, or strategy adjustments when needed.
- Consumer Confidence: Consistent testing leads to consistent products. That means happier, more loyal customers.
